Abstract
Explores the extent to which the codification of the European human rights acquis through the European Charter of Fundamental Rights and the draft Treaty Establishing A Constitution for Europe might enhance social rights and social policy discourse, and strengthen the protection of social and economic rights. Discusses: (1) the legal status of the Charter; (2) the origins of the rights and principles contained within the Charter's unconventional grouping of rights; (3) the scope and weaknesses of the substantive provisions contained in the solidarity chapter; and (4) the potential for judicial activism in interpreting the social and economic rights under the general provisions of the Charter and the implications of distinguishing between rights and principles.
